Mistress Littlestar has come out of retirement!

CMS was originally built to provide factual information about male submission and surrender. In the early years I received a lot of email thanking me for providing information about Enemas, Cross-Dressing, How to Meet Somebody, etc. However the requests for pictures of scenes far outweighed the "How do I do..." requests. The factual information is still available and continues to grow in the FAQ section. I still share local event information and class schedules.

Some of you belong to the "CMS For Members Only" section of malesubmission.com. 

It is with great anger and no small amount of pissed off beyond belief rage and sadness that I have had to temporarily suspend new signups. Why? Because of the new U.S.C. 2257 requirements that the Department of Justice has imposed upon those of us in the adults only entertainment industry.

As an Adults Only webmaster and a producer of Adults Only content, I have always tried to abide by the law. Back in 2004 it became really imperative that we had our models sign releases and provide copies of their ID's and that you posted a statement attesting to that fact as well as providing the "Custodian of Records" information. Fine. No problem. Works for me! Yes, some of our models were so obviously over 21, (grey hair, roadmaps for faces, etc. etc... AKA they looked like me! ::: grin :::) while others looked like gawds and gawdessses. For those who looked like "that" I made sure I had all the necessary documentation on file. 

Enter June 23, 2005 and the NEW regulations. 
"US rules all porn is child porn."(http://www.theregister.co.uk/2005/06/24/us_law_2257/ )Unless providers can prove the ages of everyone taking part via GOVERNMENT issued ID cards. No library cards, NO university/student ID cards, No Costco cards... So far, I'm okay with that. NOW it gets REALLY FUCKED UP.

The new rules, which are updates to regulations that date back to 1992, require porn promoters and distributors to maintain records proving their models and actors are over the age of 18, instead of signed forms and other loose documentation. In an announcement last month, Gonzales said the new rules "are crucial to preventing children from being exploited by the production of pornography." Although seemingly innocuous and for a good cause, the rules have suddenly forced the freewheeling trade to either find and organize legal documents for every performer engaging in sex, remove the pictures, or face jail time of up to five years for the first offense and up to ten years for additional offenses. 

Easier said than done. The only acceptable identification is government-issued "picture identification" cards or documents, copies of which must be available on demand from the feds, according to a guidebook circulated among big porn clients by Paul Cambria Jr., one of the trade's top lawyers. Oh, that includes any photos or movies shot within the past ten years. Good luck tracking down all those once-naked people, many of whom are foreigners or use bogus names. 

And the industry only had 30 days to get the records together from the time the regulations were announced. 

The new regulations "will likely drive law-abiding adult businesses out of the industry not because they ignored the minimum-age requirements, but because they simply cannot afford to maintain the extensive records required under the new rules," Cambria tells his clients. 

While compiling such records is hard enough for the actual producers of porn, they constitute the minority of much of what is distributed over the Internet. Most Internet porn sites are run by small-time independents who agree to distribute porn made by photographers and film producers, in exchange for a cut of as much as $70 for every purchase directed back to the originating sites. These so-called "secondary producers" now must also keep age documents for every performer, a near-impossible task that is being hotly disputed by the industry. 

The Free Speech Coalition, a front group for the porn trade, filed a motion for a temporary restraining order on Monday in Denver federal court, in which it argued that the extension of the rules to the secondary producers contradicts a 1998 federal court ruling (in the same court district) that porn distributors can't be held responsible for porn produced by someone else. A hearing scheduled for today was canceled pending a resolution of a complaint filed in the same case. In the meantime, the plaintiffs in the case (including members of the Free Speech Coalition) won't be subject to records inspections, although the new rules will be enforced for everyone else.

In other words... if you ain't a member, be prepared for a knock at the door if you are a webmaster of an adults only site. Even personal ads, banner ads and DVD covers will fall under the regulations if they're sexually explicit. Check out ALT.COM's latest requirement. If you use images provided by friends, family or volunteers and they are of a sexual nature, you better have proof of ID on hand. I don't care if the photographer gave you permission to use HIS images. Using these images makes YOU a SECONDARY PRODUCER and you're required by the new law to be able to PROVE that those in the depictions are NOT minors. Even if it's obvious that they aren't. 

The worst part is the record-keeping requirements. I truly believe this is designed to put us out of business or convince the Models to not participate... EVERY PICTURE USED must be indexed by the Models' LAST NAME, FIRST NAME, and ALL PROFESSIONAL NAMES ever used by the model, and then cross-indexed by URL, Image Name/Number, and TITLE of the series, as well as dates images were FIRST CREATED, then USED in a book, website, magazine, pamphlet, video, etc. and then every time the image is re-released or modified, it must be cross-indexed and referenced all over again. And this all needs to be done in an alphabetical order. Or numerical if needs be. AND if you purchase content from a 3rd party provider like I do, then THAT person must provide ME with the Model info even though HE didn't have a thing to do with creating such depictions. NOW we're talking about sharing information that should be private. Not only does the Custodian of the Records info have to be published, now you have to pass along the private info of the model to every single Tom Dick and SCARY pervert that asks for it. If they use the image that is.

Don't even get me started on Streaming Videos and WebCam stuff!! Needless to say, I've shelved THAT idea. 

Bottom line is this... we're still going to produce our own content.

But until I can gather all of the model ID's from the dozens of folks who donated their time and bodies to my cause, and then figure out how to build this fucking database... (I'm a lot of things, but EXCEL-savvy, I ain't!!) and then tie it into the 8 different web sites that we own, I've had to pull the CMS Members and Previews sections. Once again I am FORCED to make major changes to my website.  As you know I am a RESPONSIBLE WEBMASTER and pride myself on adhering to the rules of the industry. The Government is not playing fair.  They're trying their best to shut us (Adult Content Producers) down by burying us in so much paperwork that most of the folks are quitting rather than comply. 

We're putting our paperwork in order and building the necessary databases required by the government but it is a time consuming and onerous task set before us forcing us to temporarily remove access to ALL of the images that we've been displaying since 1997.  

They've finally defined what constitutes hard and soft porn. For this, I am quite pleased.  I don't have to like some of it, but at least now I have a guideline to follow. 

"Hardcore" is defined as any picture which shows: an erect or flaccid penis, scrotum, anus, masturbation or sexually explicit conduct as defined in 18 USCS 2256 including, but not limited to genital-genital, oral-genital, oral-anal, and anal-genital contact. Rule of thumb: Penetration, masturbation or S&M. (Exactly WHAT constitutes S&M, I'm not sure yet... )

"Softcore" content includes: face, chest, buttocks (not the anus), pubic hair and simulated sex. For these purposes examples of simulated sex includes: kissing, hugging, nipple licking or other instances where the images do not include depictions of genital-genital, oral-genital, oral-anal or anal-genital contact as defined in 18 U.S.C. 2256. Cornell University Legal Information Institute defines 18 U.S.C. 2256 here

All of this is quite acceptable to us... where we're having a problem is the fact that because we also buy, trade, and use images donated by others, the Government has decided that WE should be responsible for obtaining all of the records required to produce this type of depiction and keep it available for inspection. While we do hold proper documentation for WhackStar Productions content - almost all of our 3rd party content brokers have chosen not to release personal information or documentation of the models, performers or individuals used in their products.  Can't say that I blame them.  What this means is that I am going to have to delete complete galleries because I do not have the information required by the government.

Due to the current political climate I felt it prudent to restrict access to the more intimate and erotic content by placing the Showcase and Story sections into a "For CMS Members Only" and requiring a membership fee; This would limit exposure to minors and those who feel that what we show here is obscene. My choices were:

1. Require age verification for ALL of the files by means of a Adult Verification Service (AVS*)
2. Place the entire site into a "Members Only" Directory requiring a fee
3. Separate the erotica from the resource information and place into a Members Only directory
4. Close the site down entirely

5. AVS GIANT AdultCheck has bit the dust! Thanks to the %*^*uckers in you know where! What once was a bastion of protection for lazy parents has been brought low by VISA and it's political machine.  I wish I were a rich woman because nothing would make me happier than to be able to sue a few people. Since I'm not rich I guess I have to kowtow too! That or throw open the gates to ALL the nasty pics but since I pride myself on being a "responsible" webmaster, I won't.  I'll continue to do what I've always done. Play by the rules... try and keep the little monsters away (until they become consenting little monsters) and provide what I feel is very cool stuff! 

Yes, there are free previews and a certain amount of nudity, bdsm, bondage, etc is shown, but you have to work a bit to find it. Kids don't have that kind of patience.
